Expungement of NJ Criminal Records
In order to have your records expunged, you must petition the court in the jurisdiction where the arrest and/or conviction occurred. Expungement hearings can get complicated. In light of this, having an experienced and knowledgeable attorney represent you in your efforts to obtain an Order of Expungement is a prudent idea.
Michael J. Rogers, Esq. is knowledgeable in the laws of expungement as they pertain to the State of New Jersey and experienced in representing clients at all levels of expungement hearings.
Under New Jersey law, certain criminal and juvenile records are eligible for expungement. Simply stated, that means all records surrounding such activities are removed or isolated as if the offense never occurred. Which records are eligible for expungement varies from state to state. In New Jersey, the eligibility is determined by New Jersey expungement laws.
Certain records are relatively easy to expunge. Those would include cases in which you were found not guilty or cases involving non-violent, juvenile offenses. Other cases, however, are more difficult and can be challenged by prosecutors or a judge. These cases would involve a court proceeding similar to a trial. Still other cases are never eligible for expungement, including felonies committed by adults and certain juvenile offenses.
Reasons for Expungements
There are a number of reasons why a person would seek to have his or her record expunged. These include:
- Employment – some employers will not hire a person with a criminal record;
- Housing – some landlords refuse to rent to persons with a criminal past and sometimes they are prevented from doing this by law; and
- Education – some colleges and universities, particularly private schools, consider past criminal activity when deciding on acceptance for enrollment.
